1. Acceptance of Terms
By downloading, installing, or using Hydriq ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms constitute a legal agreement between you and the independent developer publishing Hydriq on Google Play ("we", "us", "our").
2. Description of Service
Hydriq is a hydration tracking application for Android featuring:
- Drink logging with 20+ beverage types and caffeine tracking
- A digital Spirit companion that evolves based on your hydration habits
- Smart reminders, analytics, achievements, and challenges
- Local data storage with optional encrypted Google Drive backup
- Optional cosmetic upgrades via in-app purchase (Hydriq Pro)
We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.
3. Eligibility
You must be at least 13 years old to use Hydriq. If you are under 18, you must have parental or legal guardian consent. The App contains optional alcohol tracking features intended for adult wellness use only. By enabling alcohol tracking, you confirm that you are of legal drinking age in your jurisdiction.
4. User Accounts
Hydriq does not require an account for core functionality. All features work without signing in.
If you choose to enable Google Drive backup, you will authenticate via Google Sign-In. Your Google account is governed by Google's Terms of Service. We do not create or manage separate user accounts.
5. In-App Purchases
Hydriq Pro ($2.99 one-time)
A non-consumable, one-time purchase that permanently unlocks cosmetic content (Spirit skins, outfits, accessories, theme packs) and utility features (CSV export, edit history, calendar heatmap). No core hydration tracking functionality is gated behind this purchase.
Tip Jar ($0.49 / $0.99 / $1.49)
Voluntary, consumable support tips. These provide no additional features and can be purchased multiple times.
Purchase Terms
- All purchases are processed by Google Play Billing and subject to Google Play's Terms of Service.
- Refunds are handled by Google Play. To request a refund, visit Google Play's refund page.
- Hydriq Pro is tied to your Google Play account and can be restored on any device signed into the same account.
- We do not store or process any payment card details or financial information.
6. User Content
You may create content within the App, including:
- A display name and Spirit companion name
- Custom drink entries and hydration logs
- Share card images generated from your achievements
You retain ownership of your content. By using the share features, you are responsible for what you share and where you share it. We do not collect, host, or monitor user-generated content.
You agree not to use the App's text fields to input content that is unlawful, harmful, or violates the rights of others.
7. Intellectual Property
All rights, title, and interest in the App — including but not limited to the Spirit companion designs, artwork, animations, UI/UX design, theme packs, icons, sounds, and source code — are owned by us or our licensors and are protected by applicable intellectual property laws.
Your purchase of Hydriq Pro grants you a non-exclusive, non-transferable, revocable license to use the unlocked content within the App. It does not transfer ownership of any intellectual property.
You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the App or its content, except as expressly permitted by applicable law.
8. Health Disclaimer
- Hydration goals calculated by the App are estimates based on general guidelines (weight, sex, activity level, climate). They are not personalized medical recommendations.
- The "Beverage Hydration Index" and drink quality scores are informational and based on published research, but should not replace professional dietary advice.
- Always consult your healthcare provider regarding your hydration needs, especially if you have kidney disease, heart failure, hyponatremia, or any condition that requires fluid management.
- Do not rely on the App for hydration management during medical emergencies or extreme conditions (heat stroke, severe dehydration, etc.).
9. Alcohol Tracking Disclaimer
Hydriq includes optional tracking for alcoholic beverages (beer, wine, spirits, cocktails) as part of its hydration logging features. This feature is intended for adult wellness tracking only.
- The App does not promote or encourage alcohol consumption.
- Tracking alcohol intake does not constitute medical monitoring or addiction counseling.
- If you have concerns about alcohol use, please consult a healthcare professional or contact your local support resources.
- By using alcohol tracking, you confirm you are of legal drinking age in your jurisdiction.
10. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble the App
- Attempt to bypass in-app purchase verification or unlock Pro features without payment
- Use the App for any illegal purpose
- Interfere with the App's functionality or the Google Play Billing infrastructure
- Redistribute, resell, or sublicense the App or its content
11. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how the App handles your data. By using the App, you consent to the practices described in the Privacy Policy.
12. Third-Party Services
The App integrates with Google services (Play Billing, Drive API, Sign-In). Your use of these services is governed by their respective terms:
We are not responsible for the availability, content, or practices of third-party services.
13. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any data loss will not occur.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the App
- Any errors, inaccuracies, or omissions in the App's content (including hydration calculations)
- Loss of data due to device failure, App deletion, or backup failure
- Unauthorized access to your locally stored data
- Any health decisions made based on the App's information
Our total liability for all claims arising from or related to the App shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.
16. Termination
You may stop using the App at any time by uninstalling it. We may terminate or suspend your access to certain features if you violate these Terms.
Upon termination, your locally stored data remains on your device until you delete it. In-app purchases are tied to your Google Play account and are governed by Google Play's policies.
17. Changes to These Terms
We may update these Terms from time to time. Changes will be reflected in the "Last updated" date at the top of this page. Material changes will be communicated through the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
